Fuck me days. Why do we always go through this fucking rigmarole every time mitigation gets mentioned either in rugby judiciary cases or actual judiciary cases. It's a standard part of sentencing/sanctioning.
Has he been done for this type of misconduct before? No? In which case, that's a mitigating factor.
He pleaded guilty = a further mitigating factor.
Read page 33 re mitigation if you get round to putting down the pitchforks.

I skimmed through the report and can’t really complain about the process & punishment.
It’s shit what Sexton did but perhaps not as bad as I thought and the ref team seem not as upset as I assumed they were.

Is it really an apology if it's just for mitigation, and therefore is no longer a mitigating factor?

Completely agree, though more for a wider discussion., which I’m thinking is your point.
Sexton is just playing the game, as many have done before. No surprises there or with the outcome.
Looking at that wider issue though, we all know that what goes on at the top level gets emulated all the way down the line. We have trouble getting enough refs as it is, they need to be a protected species from the top to the bottom.

Totally agree. But it's RWC year and he's a key player. And that just wouldn't do, would it? An opportunity to send a message missed.

He also wasn't even playing, didn't have the excuse it was in the heat of the game. In addition it was 3 times, not a one off, after the game. And professionals that are role models should be held to a stricter standards than club players, not lesser

It's ridiculous that an apology can be deemed a mitigating factor. It should be part of the sentence.

That's an interesting one is't it? At the time I thought Hartley hard done by as whilst he did call someone "a fucking cheat", it was pretty hard to be definite it was aimed at Barnes.
On the other hand Hartley was hardly unknown to the judiciary and had previously pushed an official in anger.
However, I thought on balance he was hard done by in that particular instance.

@sparky although I don’t necessarily have too much issue with the process and ban this incident was the first one I thought of.
Hartley could certainly argue he wasn’t talking to the ref too …. Which sexton couldn’t.

If an AB did something like this I would have no problem with a ban and would also have wanted it to be more severe.

Disappointing from Ferris, honestly. Although I don’t necessarily buy into all the rugby values tripe, ref respect is one thing which should never diminish.
