Here is how they explain it:

    • Mitigating factors could include a player’s good record
and character, the action taken to prevent the incident occurring
again, an apology and remorse. Aggravating factors could include
the player being classified as a persistent offender of the
laws of the game, a lack of remorse or the need for a deterrent
to combat a pattern of offending.

@Crucial That makes more sense. From that it seems that there is no relevance placed on provocation?

I don't think he deliberately aimed at the head. He probably feels a bit hard done by because of his own stupid reaction.
When it happened I initially though he put his foot down to regain balance as he looked about to fall with Marler hanging onto his other leg. It was the reserve angle shot that condemned him though where you can see him stamp. If he had simply placed his foot on Marler and put his weight on it he would have had a good argument of regaining balance.
    Dumb reaction.

Could be. Then again, maybe veganism is a missed steak...

For lack of a better thread to post this:

Former Crusader (now Ospreys) Kieron Fonotia has made himself available for Samoa. I'm surprised; I had no idea he had links to Samoa. I always thought his name was Italian 🤔 Never good enough for higher honours in NZ, but wouldn't be a bad choice for Samoa.
