Also got aggravating factors applied for previous which added two weeks back on
10 was reduced to 6 then back up to 8 -
Just watched the clip and from that it is obvious that players/coaches and laws and still not singing from the same book. Aki argues that he can’t clean out any other way but that is the whole point. If you can’t, you don’t. There is no right to clean out if someone is over the ball only a right to try to do so legally.
Interesting that he was charged under failure to bind which is good but his binding attempt is no different to others actions all the time. I maintain that WR have left the option for this type of thing to happen by not enforcing proper binding and punishing afterwards only when head contact happens is not preventative -

Yes - there's a graphic somewhere from URC showing the rationale for his ban, including mitigation, but also taking into account his previous red cards.
"“These mitigating factors warranted a reduction in the sanction of four weeks. The player’s previous suspensions for red cards in 2019 and 2021 for foul play involving head contact, as well as his suspension and warning for previous conduct relating to interactions with referees, were considered aggravating factors, which the judicial officer decided warranted a further two weeks of sanction."

This is what I responded to in my case. Mitigation is on the event and its severity alongside the player's response. Track record is then assessed against the sanction and a further sanction is applied if warranted. That's the process. As with all cases, an opportunity to reduce the length of the agreed ban if the guilty party undergoes training is included. In this instance, it's unlikely to make any difference as Aki has not been selected for the test squad and would not be ready for the third test.

@Derm-McCrum I thought he wasn't selected due to being banned? Mitigation for being sorry should be extremely rare when you're in front of the judiciary on your 3rd strike.

I quite agree.
You're right, he wasn't selected because he was banned. In theory, that doesn't stop Farrell bringing him in for 3rd test vs Australia if Aki were to do the rehab training, but he still would have no prep time so Farrell won't.
