As explained, the directive specifically takes upright tackling into account because of the risk.
I could accept if they looked at it and decided yellow but the refs seemed to think like you that Smith’s punishment was having a cut.

Upright tackles when you have clear line of sight are illegal. For the very reason we just saw. Care of duty is with the tackler.
If you make contact with the head with your own head in a tackle you go down the decision path. Clear sight is an aggravating factor -
